JOB APPLICANT PRIVACY POLICY

1 Introduction  

We are committed to protecting Your privacy. This Privacy Policy describes how We collect, use, store, share and protect the personal information collected through Our employment application and recruitment process. In this Privacy Policy, "We", "Us", and "Our" refer to Zero Acre Farms Inc.

Please be advised that the practices described in this Privacy Policy apply only to information gathered as part of Our recruitment process pertaining to job applicants (“You,” or “Your”) who apply for or are recruited for a job with Us. In particular, this Privacy Policy applies to information We, and not third parties, collect through Our job application websites, in email or other electronic messages between You and Us relating to the employment recruitment and application process, through mobile and desktop resources You may download from Our job application websites, and any other means whereby We collect personal information from You relating to the application and recruitment process. This Privacy Policy does not apply to (i) Us offline or through any other means not related to Our application and recruitment process (including other websites operated by Us or any third party) or (ii) any other third party including through any application or content that may be accessible during the application or recruitment process. 

This Privacy Policy does not create or form part of any contract for employment or otherwise with Us. 

PLEASE READ THIS PRIVACY POLICY CAREFULLY because it affects Your rights under the law. You confirm that You have read and agreed to be bound by this Privacy Policy. If You do not agree with this Privacy Policy, You cannot use or access our recruitment processes, however, please get in touch with Us. This Privacy Policy may change as We evolve Our recruitment policies, so please check it periodically and as may be applicable to You. 

We reserve the right to modify or amend the Privacy Policy from time to time without prior notice. Your continued engagement in Our recruitment process following the posting of changes to this Privacy Policy mean You accept those changes. Our recruitment process and Your potential engagement therewith is not intended for minors under the age of 18. 

2 Information We Collect And How We Collect It

We collect several types of information from and about users of the Platform, including:

  • by which You may be personally identified, such as first and last name, phone number and e-mail address, previous and current employers, and social security information (“personal information”);

  • that You voluntarily enter, such as Your first and last name, Your email address, Your age, Your physical address, and Your nationality. 

  • that is about You but individually does not identify You, such as the city where You reside; 

  • Information that You provide such as previous employment history (such as employer names, job titles and positions held), schools You’ve attended, degrees or certifications You’ve earned, grade or class results, disciplinary records, or other education information and records, and information included in Your application for employment, including but not limited to the position or role that You applied for, the date of Your application, and the method used to apply. 

We collect this information directly from You when You provide it to Us through the recruitment process, job application and resume submission, communications with Us, and subsequent employment or hiring processes. 

In some countries, including countries in the EEA, the information referenced above in this Privacy Policy may be considered personal information under applicable data protection laws. If You do not want us to collect this information, do not use the Platform.

3 Do Not Track Settings

We do not track You over time and across third party websites to provide targeted advertising. We respond to Do Not Track (DNT) signals. However, some other third-party websites do keep track of Your browsing activities so that they can tailor the information or advertising they present to You. If You are visiting such sites, Your web browser may allow You to set the DNT signal on Your browser so that third parties (particularly advertisers) know You do not want to be tracked.

4 Third-Party Use of Cookies and Other Tracking Technologies

Some content and processes associated with providing You with Our employment application and recruitment processes are served by third-parties. For example, We use Greenhosue Software Inc. and Google for Our internal purposes associated with Our recruiting processes. These (and other) third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about You when You are engaged in Our employment application and recruitment process. The information they collect may be associated with Your personal information or they may collect information about Your online activities over time and across many online services. 

We do not control these third parties’ tracking technologies or how they may be used. If You have any questions about targeting content, You should contact the responsible provider directly.

5 How We Use Your Information  

We use the information that We collect about You or that You provide to Us:

  • To consider and evaluate job applicants and their respective qualifications, skills, and interests (as may be communicated in their employment application materials or otherwise) for current and potential future employment or engagement opportunities with Us.

  • To communicate with applicants about Our current and potential future employment and engagement opportunities, including scheduling interviews or other measures to further evaluate a job applicant. 

  • To evaluate and verify information collected by You during the recruitment and application process. 

  • To keep records of Our interactions and communications with You and to further support, administer, and manage Our recruitment processes. 

  • For the protection of Our operations or to protect Our rights, privacy, safety or property, or that of Our employees, service providers, vendors, or other parties. 

  • To comply with applicable laws, regulations, and legal process. 

  • To third party vendors, as necessary, for Us to consider particular job applicants for employment (including third parties that host Our job applicant portal or facilitate internal purposes associated with Our recruitment process). 

  • In any other way We may describe when You provide the information.

Please note that if You are subsequently employed by Us, the information obtained through the recruitment and employment application process may become part of Your employment record with Us and may be used by Us for employment related means, subject to applicable laws, regulations, and legal process. 

6 Sharing and Disclosure of Your Information  

We may disclose aggregated information about You and information that does not identify any individual, without restriction.

We may disclose personal information that We collect or You provide:

  • To Our subsidiaries and affiliates.

  • To contractors, service providers, and other third parties We use to support Our recruitment process. For example purposes, we may provide Your personal information to third party recruiters or sources that We work with to efficiently manage the recruitment process. 

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Us about job applicants is among the assets transferred.

  • To fulfill the purpose for which You provide it. 

  • For any other purpose disclosed by Us when You provide the information.

  • To third party contractors in order to analyze and/or improve Our recruitment and employment application performance and processes. 

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • If We believe disclosure is necessary or appropriate to protect the rights, property, or safety of Us, our customers, or others.

7 Data Retention

We retain personal information We collect from You where We have an ongoing legitimate business need to do so (for example, to provide You with Our recruitment and employment application or engagement experience or to comply with applicable legal, tax, or accounting requirements).

When We have no ongoing legitimate business need to process Your personal information, We will either delete or anonymize it or, if this is not possible (for example, because Your personal information has been stored in backup archives), then We will securely store Your personal information and isolate it from any further processing until deletion is possible. 

8 Accessing and Correcting Your Information  

You can review and change Your personal information by sending Us at careers@zeroacre.com to request access to, correct, or delete any personal information that You have provided to Us. We may not accommodate a request to change information if We believe the change would violate any law or legal requirement or cause the information to be incorrect. 

9 Your California Privacy Rights  

California Civil Code Section § 1798.83 permits job applicants that are California residents to request certain information regarding Our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to careers@zeroacre.com

10 Transferring Your information

We are a worldwide service and Our recruitment and job application processes may be accessed anywhere in the world. By engaging in Our recruitment and job application process, You authorize Us to transfer and store Your information outside Your home country, including in the United States, for the purposes described in this Privacy Policy. The privacy protections and the rights of authorities to access Your information in these countries may not be the same as in Your home country. We take additional measures when information is transferred from residents of the European Economic Area (EEA). This includes relying on European Commission adequacy decisions about certain countries, as applicable, for data transfers to countries outside the EEA.

11 Data Security  

We follow generally accepted industry standards to protect the information submitted to Us, both during transmission and once We receive it. We maintain appropriate administrative, technical and physical safeguards to protect Your personal information against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the personal information in Our possession. This includes, for example, firewalls, password protection and other access and authentication controls. Further, We use HTTPS (Hypertext Transfer Protocol Secure), an internet communication protocol that protects the integrity and confidentiality of data provided consistent with this Privacy Policy.  The use of HTTPS makes sure Your communication with Us is: (i) encrypted, (ii) integral, and (iii) authenticated. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. We cannot ensure or warrant the security of any information You transmit to Us or store through Your engagement or potential engagement with Our recruitment and employment application process, and You do so at Your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of Our physical, technical, or managerial safeguards. 12 EEA Users

You have options in relation to the information and data that We have about You.  To exercise any of the options discussed below, please contact Us at careers@zeroacre.com. If You’re an EEA user, You may:

  • Access the information We have about You. We'll will make an effort to share this information with You within a reasonable time.

  • Have Your information corrected or deleted. 

  • Object to Us processing Your information. You can ask us to stop using Your information, however, note that Your request for Us to stop using Your information may interfere with Your engagement with Us and Our ability to engage with You throughout the recruitment process. 

  • Withdraw Your consent for Us to collect and process Your personal information at any time.  Withdrawing Your consent will not affect the lawfulness of any processing We conducted prior to Your withdrawal, nor will it affect the processing of Your personal information conducted in reliance on lawful processing grounds other than consent.

  • Have the information You provided to Us sent to another organization, where We hold this information with Your consent or for the performance of a contract with You, where it's technically feasible.

  • Complain to a regulator. If You're based in the EEA and think that We haven't complied with data protection laws, You have a right to lodge a complaint with the Data Protection Commission in Ireland or with Your local supervisory authority.

We respond to all requests We receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. 

13 Legal Basis for Processing Personal Information

Our legal basis for collecting and using the personal information described in this Privacy Policy will depend on the personal information concerned and the specific context in which We collect it. However, We will normally collect personal information from You only (i) where We need the personal information to perform a contract with You; (ii) where the processing is in Our legitimate interests and not overridden by Your rights; or (iii) where We have Your consent to do so.  We have a legitimate interest in operating and managing Our recruitment process and communicating with You as necessary to provide engagement consistent therewith. 

In some cases, We may also have a legal obligation to collect personal information from You or may otherwise need the personal information to protect Your vital interests or those of another person. If We’ve ask You to provide personal information to comply with a legal requirement or obligations associated with the recruitment process with You, We will make this clear at the relevant time and advise You whether the provision of Your personal information is mandatory or not (as well as of the possible consequences if You do not provide Your personal information).
